Turkey: Lawsuit Against Derya Okatan Drags On, CFWIJ Demands End To Legal Harassment

December 16, 2021, İstanbul – The seventh hearing of the trial against journalist Derya Okatan over a public insult charge has not been seen today due to the judge’s leave. The trial was adjourned for a further date. The Coalition For Women In Journalism demands an end to legal harassment against women journalists. According to the prosecutor’s opinion from the previous hearing, the journalist should be acquitted of all charges. The CFWIJ agrees with the opinion and demands an immediate verdict to Derya upon the prosecutor’s request.
The seventh hearing of the case with the allegation of "public insult" against journalist Derya Okatan has not been seen today in İstanbul 39th Criminal Court of First Instance. The hearing was adjourned to a further date without any progress. In July’s trial the prosecutor, Emre Karaman, requested an acquittal to Derya on accounts of press freedom. The prosecutor said the alleged crime was not proven against the journalist. The verdict was supposedly expected for today's hearing but it was not held due to the judge’s leave. The trial will be scheduled for a further date.
Derya faced charges over a news report entitled "Mersin Women's Platform: We are exposing the harassing lawyer Onur Kale," published on Etkin News Agency’s (ETHA) website in May 2016. The report incriminated Kale as the sexual harasser of atleast eight women associated with the Mersin Women's Platform. At least eight women activists, who were detained in Mersin, when preparing for International Women’s Day, came forward with their experience of facing sexual harassment during custody.
Shortly after the report was published, an investigation was launched against Derya, the managing editor of ETHA at the time, on Kale’s complaint.The prosecutor dismissed the investigation at that time. However, Derya Okatan was sued as a result of the objection.
In the indictment, the journalist was accused of "containing a concrete assertion of an act that would offend the honor and dignity" and Derya was facing up to two years sentence in prison for "public insult".
The case is not the only one in which Okatan faced legal ordeal. The journalist is being prosecuted on charges of spreading propaganda for a terrorist organization and blocking, disrupting the information system, destroying, or changing data among six journalists who covered the emails allegedly belonging to former Finance Minister Berat Albayrak. Derya faces up to 11 years of sentence in prison in this case.
The Coalition For Women In Journalism demands an end to legal persecution against women journalists. The prosecutor of Derya’s trial gave a good example on accounts of press freedom while presenting his opinion. The opinion must set a precedent for other cases. We expect a fair verdict from the judge to acquit Derya Okatan in the next session.

Türkiye: Gazeteci Derya Okatan’ın davası görülmedi
16 Kasım 2021, İstanbul – Gazeteci Derya Okatan’ın “hakaret” suçlamasıyla yargılandığı davanın yedinci duruşması bugün hakimin izinli olması nedeniyle görülmedi. Duruşma ileri bir tarihe ertelendi. Bir önceki duruşmada esas hakkında mütalaasını sunan dava savcısı, Derya’nın yayınladığı haberin ‘basın özgürlüğü’ kapsamına girdiğini belirterek gazetecinin beraatını talep etmişti. Gazetecilikte Kadın Koalisyonu (CFWIJ) olarak savcılık talebine katılıyor, mahkemenin gazetecinin davasını derhal sonuca kavuşturarak beraat kararı verilmesini talep ediyoruz.
Gazeteci Derya Okatan’a, Etkin Haber Ajansı’nda (ETHA) sorumlu yazı işleri müdürü olduğu dönemde yayınlanan “Mersin Kadın Platformu: Tacizci avukat Onur Kale’yi teşhir ediyoruz” başlıklı haber nedeniyle “alenen hakaret” suçlamasıyla açılan davanın yedinci duruşması hakimin izinli olması nedeniyle görülmedi. Duruşma İstanbul 39. Asliye Ceza Mahkemesinde görülecekti.
Derya’nın Temmuz’da görülen duruşmasında dava savcısı, Emre Karaman, esas hakkındaki mütalaasını mahkemeye sunmuş, dava konusun basın özgürlüğü kapsamında ele alınması gerektiğini ve atılı suçun sübut bulmadığını belirterek, gazeteci hakkında beraat talep etmişti. Bugün görülmesi beklenen duruşmada kararın çıkması bekleniyordu.
1 Mayıs 2016’da ETHA’da yayınlanan haberde, avukat Onur Kale’nin, Mersin Emniyet Müdürlüğü Terörle Mücadele Şube Müdürlüğü’nde gözaltına alınan Mersin Kadın Platformu’ndaki sekiz kadına cinsel tacizde bulunduğu iddia ediliyordu. Haberin ardından avukat Kale’nin şikayeti üzerine gazeteciye soruşturma açılmıştı. Soruşturmaya, İstanbul Cumhuriyet Başsavcılığı tarafından “kovuşturmaya yer olmadığına” karar verilmiş, takipsizlikle sonuçlanmıştı. Ancak Onur Kale’nin İstanbul 14. Sulh Ceza Hakimliğinde itirazı sonucu Derya Okatan’a dava açıldı.
Gazeteciye yönelik hazırlanan iddianamede, avukat Kale’nin “onur, şeref ve saygınlığını rencide edecek nitelikte somut bir fiil isnadı içerdiğini” iddia edilmiş, ETHA’nın web sitesinde yayınlanan habere yönelik “aleni hakaret suçunun oluştuğu” belirtilmişti. Gazeteci hakkında “alenen hakaret” suçlamasıyla üç ay 15 günden iki yıl dört aya kadar hapis cezası istenmişti.
Bugün görülmesi beklenen dava gazetecinin yargılandığı tek dava değil. Gazeteci, Berat Albayrak'a ait olduğu iddia edilen e-postaları haberleştiren altı gazeteciyle birlikte “terör örgütü propagandası yapmak” ve “bilişim sistemini engelleme, bozma, verileri yok etme veya değiştirmek” suçlamalarıyla da yargılanıyor. Derya hakkında üç yıldan 11 yıla kadar hapis cezası isteniyor.
Gazetecilikte Kadın Koalisyonu olarak gazetecilere yönelik yasal yolla tacizin sona ermesini talep ediyoruz. Bir önceki duruşmadaki savcılık mütalaasının diğer davalara da emsal olmasını talep ediyoruz. Derya Okatan hakkında derhal beraat kararı vermesini istiyoruz.
